These Terms of Service (“Terms”) govern your access to and use of the website located at lemonathletics.com and any related services (collectively, the “Site”), which are operated by Aurora United LLC (“Lemon Athletics,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or enter into a binding agreement with us. By using the Site you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

We sell performance pickleball and athletic apparel and equipment. We make reasonable efforts to display product descriptions, images, colors, and pricing accurately, but we do not warrant that such content is error-free, complete, or current.

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice — including after you have submitted an order.

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by us, and we may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, or refuse or cancel any order.

If we cancel an order after you have been charged, we will issue a refund to your original method of payment.

Payment card details are entered through and processed by our PCI-compliant third-party payment processor. By submitting payment information, you represent that you are authorized to use the designated payment method and you authorize us to charge it for the total amount of your order, including taxes and shipping.

We do not store full payment card numbers on our servers.

We will make reasonable efforts to ship orders promptly, but delivery dates are estimates and not guaranteed. Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, or events beyond our reasonable control.

Eligible items may be returned in accordance with our return policy. To start a return or ask about a refund, contact us at support@lemonathletics.com. Refunds, where granted, are issued to the original method of payment. Certain items may be final sale where indicated.

The Site and all of its contents — including text, graphics, logos, images, product designs, and software — are the property of Lemon Athletics or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission.

You agree not to use the Site for any unlawful purpose, to interfere with or disrupt the Site or its security, to attempt to gain unauthorized access to any systems or accounts, or to engage in any activity that could damage, disable, or impair the Site. We may suspend or terminate your access for any violation of these Terms.

The Site and all products are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

To the fullest extent permitted by law, Lemon Athletics and Aurora United LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or any products purchased through it. Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold harmless Lemon Athletics, Aurora United LLC, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Aurora United LLC is organized, without regard to conflict-of-law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located there.

We may revise these Terms from time to time. When we do, we will update the “Last updated” date below. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
